The Seven-Day Rule: Are Your Scaffold Inspection Records Actually Legal?

Most site managers know they need to inspect scaffolding. But there is a big difference between a quick look and a legally robust inspection record. If an HSE inspector walks onto your site today, could you prove that your structure was safe at 9:00 AM last Tuesday?

The Statutory Requirement for Scaffolding

Under Regulation 12 of the Work at Height Regulations 2005, any scaffold used for a working platform where a person could fall 2 metres or more must be inspected:

  • Before it is used for the first time.
  • At regular intervals if the working platform is below 2m.
  • If the platform is at 2m or above, at least every seven days thereafter.
  • After a substantial alteration.
  • After any event likely to have affected its stability, such as high winds or a vehicle strike.

Crucially: This inspection must be carried out by a competent person with suitable skills and experience for the type and complexity of the scaffold, enabling them to identify any present risks and decide upon the required control measures.

The Paperwork Trap in Site Safety

The law is clear. A written report must be completed by a competent person. A simple "Scafftag" or a visual check is helpful for operatives, but it does not satisfy the statutory requirement for a record of inspection.

If you do not have a signed and dated report, the inspection effectively did not happen in the eyes of the law.
